CHS to give NOC for EV Charger installation in 7 days!

Earlier we had reported about the sad plight about an Ather Owner who did not get NOC from his building management committee to install charging station for his Ather electric scooter. But now it is no longer the case in Maharashtra… at least by law. Meaning if they refuse to give you NOC you can take them to court.

Some times the reasons could be genuine but in most cases the intention of these management committee is not so innocent. These people have refused cabling connections to Reliance Jio Fiber & Airtel XStream Fiber connections citing reasons like it will make the building weak.

But those days are gone now…

Maharshtra Cooperative Housing Societies and Resident Welfare Associations (RWA) have been asked to grant no objection certificates (NOCs) to Electric Vehicle (EV) owners for installing EV charging points on society premises within 7 days of the date of application.

An NOC (template provided in Annexure-II) should be granted by the housing society/RWA to any EV owner that wishes to set up a charging point within the building premises.

The housing society/RWA should grant NOC to the EV owner within seven days from the date of application (template provided in Annexure-I).”

According to guidelines issued by the Maharashtra government:

  • A minimum of 5 meters distance should be maintained between a vehicle and the charging point for EVs.
  • All the sockets for the EV charging point should be installed within a height of 800 mm above the highest flood level.
  • The charging points can only be installed away from the children’s play areas.

Recently Amit Dholakia and Sohel Kapadia, had filed a PIL in Bombay High Court stating that there was a lack of regulations or guidelines regarding installations of EV charging stations within the housing societies.

This lead to The Bombay High Court recently issuing notice to the Maharashtra government directing it to issue guidelines for installing Electric Vehicle (EV) charging stations on the premises of cooperative housing societies (CHS).

      1. Although the press release of Nov/Dec 2022 seems to mention a circular to the bylaws of Cooperative Housing Society we are unable to find such a link online.       2. If anyone can find link to such a circular pls mention it in the comments as it will be useful to many.
      3. Have you checked with the EV Dealer? Pls press them to get the circular. The EV companies/Dealer should take it upon themselves to educate the public about these circulars & Bylaws, after all they are the ones making the money.
